Consignment Terms and Conditions
Unless otherwise required by J&H Lan-mark Inc., d.b.a. J&H Outdoors, this Agreement shall apply to all consignments made by the Consignor on or after the date of this Agreement.
All consignments are subject to J&H Outdoors’s acceptance procedures and policies, including,
without limitation, instructions for preparing merchandise for consignment, each as in effect from time to time. J&H Outdoors may modify or amend its policies and procedures in its discretion and without notice to the Consignor. All merchandise offered for consignment must be gently used, clean, and free of rips, tears, and other defects.
PRICING & SALES PROCEEDS
- J&H Outdoors will set all prices at its discretion. Delivery of merchandise to J&H Outdoors constitutes the consignor’s acceptance of the price set for each item.
- As used in this Agreement, “Store Credit” means credit against the purchase of any item or merchandise available for sale at J&H Outdoors.
- Price Reduction: After 45 days, J&H Outdoors may reduce the price of any item by up to 50% at its discretion.
PAYMENT
- Check Payments: If the Consignor elects to receive a check, J&H Outdoors will issue a check at the end of consignment (90 days) or once all items have sold, whichever comes first. Checks shall be available for pickup at J&H Outdoors’ address. Checks must be cashed within 90 days of issuance; uncashed checks will be voided and will not be reissued.
- Store Credit: Store Credits will be issued at the end of consignment (90 days) or once all items have sold, whichever comes first, in the form of a gift card. Store Credits are valid at J&H Outdoors’ physical location, available at any time, and does not expire.
Notice of items sold and unsold will be shared via email at the end of the consignment. Any unsold items must be picked up within 7 days of the notification.
TIME LIMIT
Consigned merchandise not sold by J&H Outdoors, or not removed by the Consignor, within 90 days from the start of consignment becomes the sole property of J&H Outdoors. Once an item reaches 90 days, the Consignor will receive an email notification to pick up the item within 7 days of the notice.
Consignors may request the return of consigned merchandise at any time prior to sale by emailing Consignment@jhoutdoors.com. Requests are processed Monday through Friday and may take up to
48 hours to complete. Once processed, J&H Outdoors will remove the item from consignment and notify the Consignor via email. The Consignor then has 7 days to pick up the merchandise.
Due to operational processes, J&H Outdoors cannot accommodate immediate or on-demand
removal of consigned items. Adequate notice is required to ensure proper handling and processing
of all requests.
ABANDONED PROPERTY
Items Not Accepted or Unable to Sell at Drop-Off:
If J&H Outdoors determines that any item delivered for consignment does not meet acceptance standards or cannot be sold, the Consignor will be notified via email. The consignor must arrange
pickup within 7 days of notification. Unclaimed items shall be considered abandoned, and J&H
Outdoors may dispose of, donate, or retain the merchandise at its sole discretion without further
obligation.
Unsold Merchandise After 90 Days:
Merchandise remaining unsold for 90 days from the start of consignment shall be removed from consignment, and the Consignor will be notified via email that the item did not sell. The Consignor will then have 7 days from the date of notification to pick up the merchandise. If the item is not picked up within this period, it shall be deemed abandoned, and J&H Outdoors may dispose of, donate, or retain the merchandise at its discretion without further notice or obligation.
Consignor Responsibility:
Consignors are solely responsible for ensuring timely pickup. J&H Outdoors is not liable for any loss, damage, or disposal of abandoned merchandise.
WAIVER OF LIABILITY
All consigned merchandise remains the property of the Consignor, and risk of loss remains with the Consignor, unless and until the merchandise is sold or becomes the property of J&H Outdoors under this Agreement. J&H Outdoors shall not be responsible or liable for loss, theft, damage, or destruction of consigned merchandise.
INDEMNIFICATION
Consignor agrees to indemnify and hold harmless J&H Outdoors, its owners, agents, and employees, from any and all liability, claims, and lawsuits, including attorney's fees and costs, arising out of the acceptance, storage, handling, or sale of consigned merchandise.
CONSENT TO TERMS
By delivering or dropping off items for consignment at J&H Outdoors, the Consignor acknowledges that they have read, understand, and agree to be bound by all of the terms and conditions set forth in this Agreement. No signature is required; acceptance of these terms is indicated by checking the acknowledgment box on the drop-off form.
